Acceptance of Terms

By accessing or purchasing from the Elect Adam Forgie Store (the “Store”), you agree to these Terms, Privacy, and Store Policies. If you do not agree, do not use the Store. These Terms constitute the entire agreement between you and the Store.

Eligibility & Age Requirements

The Store is intended for individuals 18 years of age or older. Minors may only use the Store with the involvement and consent of a parent or legal guardian. The Store is not responsible for use by individuals who misrepresent their age or authority to consent.

Merchandise Sales & Campaign Compliance

All items sold through the Store are campaign merchandise sold exclusively at fair-market value. The Store does not accept political contributions, and no purchase constitutes a donation under federal or state law. Purchasers acknowledge that buying merchandise does not confer donor status.

Orders, Pricing & Payment

Order placement constitutes an offer to purchase. The Store reserves the right, in its sole discretion, to correct pricing errors, cancel orders, limit quantities, or delay fulfillment pending fraud or security review. Payment authorization does not constitute acceptance. Temporary authorization holds may appear on payment methods. Chargebacks are governed by the applicable payment processor rules.

Shipping, Returns & Refunds

All sales are final except as required by law. The Store does not accept returns for change of mind. If an item arrives defective or incorrect, the Store may, at its discretion, offer a replacement or refund, provided photos of the item are submitted within three (3) days of delivery. Shipping damage must be reported within seven (7) days of delivery. The Store is not responsible for delays, damage, or loss caused by shipping carriers once items are tendered to the carrier.

Taxes

Applicable Pennsylvania sales tax and other required taxes will be collected at checkout in accordance with law.

Privacy & Data Practices

The Store collects only data necessary to process transactions and operate the Store. Personal information is not sold or shared for value. Information may be processed by third-party service providers such as payment processors and hosting providers. Users may request access, correction, or deletion of personal data subject to legal retention requirements.

Transactional Email Communications.
The Store may send email communications solely as necessary to complete and service a transaction, including order confirmations, payment receipts, shipping notices, delivery updates, refunds, replacements, and customer support responses. The Store does not send marketing, promotional, fundraising, or campaign-related emails.

SMS Communications

The Store does not currently use SMS messaging for marketing or transactional communications.

Accessibility

The Store aims to conform to WCAG 2.1 AA accessibility standards and welcomes feedback.

Intellectual Property

All designs, artwork, and creative assets are the exclusive property of Treelady Media, LLC. Campaign names and marks are used under license. Unauthorized use is prohibited.

Disclaimers & Limitation of Liability

The Store is provided “as is.” To the maximum extent permitted by law, the Store disclaims all warranties and limits its total liability to the amount paid for the merchandise. The Store is not liable for indirect, incidental, consequential, or special damages, including lost profits or business interruption.

Indemnification

You agree to indemnify and hold harmless the Store, the campaign, and Treelady Media, LLC from any claims, damages, or expenses arising from misuse of the Store, including claims relating to lost profits or business interruption.

Governing Law & Venue

These Terms are governed by the laws of the Commonwealth of Pennsylvania. Exclusive venue lies in Allegheny County, Pennsylvania.

Changes to Terms

These Terms may be updated from time to time and will apply prospectively only. Continued use of the Store constitutes acceptance of revised Terms.
